NDA and IP Ownership in Software Outsourcing: What to Actually Check

3. The "Open Source" Trap

Many offshore developers use open-source libraries (which is standard and good for speed). However, some open-source licenses (like GPL) contain "viral" clauses. If a developer uses GPL code in your proprietary app, you might be legally forced to make your entire codebase open-source and free to the public.

4. Access to the Source Code
