Annual Maintenance Contract (AMC) for Software: What Should Be Included

An Annual Maintenance Contract (AMC) for your software is like an insurance policy for your digital business. It guarantees that an engineering team is on standby to keep your servers running, patch security holes, and fix bugs as your user base grows.

However, many agencies sell "ghost AMCs"—they charge you a monthly retainer but do absolutely nothing unless you complain.

If you are negotiating a Software AMC in 2026, here are the non-negotiable items that must be explicitly written into the contract.

1. 24/7 Server Uptime Monitoring

Your agency should not rely on you to tell them the app is down. The AMC must state that the agency will implement automated monitoring tools (like Datadog, New Relic, or AWS CloudWatch). If the server CPU spikes or the database crashes at 3:00 AM, the agency's DevOps team should be automatically alerted and begin fixing it immediately.

2. Routine Security and Dependency Patching

Modern software relies on hundreds of open-source libraries. When a vulnerability is found in one of those libraries, hackers exploit it globally within hours. Your AMC must guarantee that the agency will perform routine (usually monthly) dependency updates and immediately apply critical zero-day security patches.

3. Explicit Service Level Agreements (SLAs)

A good AMC defines response times based on severity. Ensure the contract includes a matrix similar to this:

  • Critical (System Offline): Acknowledged in 30 mins, resolution initiated immediately.
  • High (Core Feature Broken): Acknowledged in 2 hours.
  • Low (Minor UI Glitch): Acknowledged in 24 hours.

4. Retainer Hours for Minor Improvements

Maintenance isn't just fixing broken things; it's small iterations. A strong AMC will include a set bucket of hours (e.g., 10-20 hours a month) that you can use for small feature tweaks, updating text, or adding a new tracking pixel without having to draft a new contract.

5. Monthly Reporting

You should never wonder what you are paying for. The contract should stipulate that you receive a detailed monthly report outlining server uptime, the number of bugs fixed, security patches applied, and how the retainer hours were spent.

Fanya Tech provides transparent, SLA-backed Annual Maintenance Contracts for enterprise software and mobile apps. Keep your product secure and scale with confidence.
